Intelldata LLC, a Delaware Corporation, operates the website at www.intelldatallc.com (the Site). By using or submitting information to the Site, you agree to the terms of this Privacy Policy and the Terms of Use located at www.intelldatallc.com. If you have another agreement with us, different privacy provisions may apply.

This Privacy Policy also applies to individuals who receive email marketing material from partner websites, third-party partner websites, or opt-in email lists managed by us (List Management Arrangements). We take privacy seriously and aim to inform you about how we collect, use, and disclose your information, except for information submitted for sweepstakes entry. Each sweepstakes has its own Official Rules and Privacy Policy for information sharing and disclosure.

Privacy Rights of California Residents

California Civil Code Section 1798.83 permits California residents who have provided personally identifiable information to us or our partners in List Management Arrangements to request certain information regarding our disclosure of personally identifiable information to third parties for their direct marketing purposes. Within thirty days of receiving such a request to the email address stated in the Notifications section above, we will provide a list of the categories of personally identifiable information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year and the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the address specified in this section.

Residents of the European Union and United Kingdom

If you are a resident of a European Union member state or the United Kingdom, the General Data Protection Regulation (“GDPR”) and its UK equivalent provides you with specific rights regarding your PI, including: (i) the right to request access to your PI; (ii) the right to correct your PI; (iii) the right to restrict or delete your PI; and (iv) the right to object to our processing of your PI. If you are a resident of a European Union member state or the United Kingdom and would like to exercise any of these rights under the GDPR, please send us an email with a description of the nature of your request and the PI at issue, if any. We will respond as soon as we can and within the timeframe permitted under applicable law. We will verify your identity prior to fulfilling your request, which may require government identification.

Governing Law; Arbitration

This Privacy Policy is to be governed by and construed in accordance with the internal laws of the State of Florida, without regard for principles of conflicts of laws. Any civil action, claim, dispute or proceeding arising out of, or relating to, this Privacy Policy shall be referred to final and binding arbitration, before a single arbitrator, under the commercial arbitration rules of the American Arbitration Association in Broward County, Florida. You and we shall select the arbitrator, and if you and we are unable to reach agreement on selection of the arbitrator within thirty (30) days after the notice of arbitration is served, then the American Arbitration Association shall select the arbitrator. Arbitration shall not commence until the party requesting it has deposited One Thousand Dollars ($1,000.00) with the arbitrator as a retainer for the arbitrator's fees and costs. The party requesting arbitration shall advance such sums as are required from time to time by the arbitrator to pay the arbitrator's fees and costs until the prevailing party is determined or the parties have agreed in writing to an alternate allocation of fees and costs.

Judgment upon any award rendered by the arbitrator shall be final, binding and conclusive upon you and us, and your and our respective administrators, executors, legal representatives, successors and assigns, and may be entered in any court of competent jurisdiction. Notwithstanding the previous sentence, in no event shall either you or we be entitled to punitive, special, indirect or consequential damages, and both you and we hereby waive your rights to any punitive, special, indirect or consequential damages, including, but not limited to, damages for any loss of profit, revenue or business. You agree that, subject to the previous sentence, such an award by the arbitrator shall be your sole and exclusive remedy pursuant to this Privacy Policy.

Miscellaneous

If any portion of this Privacy Policy is deemed unlawful, void or unenforceable by any arbitrator, this Privacy Policy as a whole shall not be deemed unlawful, void or unenforceable, but only that portion of this Privacy Policy that is unlawful, void or unenforceable shall be stricken from this Privacy Policy. The headings contained in this Privacy Policy are for convenience of reference only, are not to be considered a part of this Privacy Policy, and shall not limit or otherwise affect in any way the meaning or interpretation of this Privacy Policy.

All covenants, agreements, representations and warranties made in this Privacy Policy, as may be amended by us from time to time, shall survive your acceptance of this Privacy Policy.

This Privacy Policy and the Terms of Use represent the entire understanding and agreement between you and us regarding the subject matter of the same, and supersede all other previous agreements, understandings and/or representations regarding the same.
